RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

Terms and Conditions:

1. All reservations must be scheduled ahead of time. Walk-ins to Community Sauna sessions may be accommodated depending on availability.

2.  Payment in full is due prior to entering the sauna.

3. Please remove shoes before entering the hot room.

4. We request guests sit on a towel while in the sauna and wipe the seat and backrests when leaving the sauna to be considerate of the next guest.

5. Remove all jewelry prior to entering the hot room/sauna.

Half Moon Lake Swimming Advisory:

Be advised there is no lifeguard on duty at Half Moon Lake. I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY for losses, costs, and damages I and/or my guests incur as a result of my and/or my guest’s participation in the Sisu Nordic Sauna.

In exchange for permission for me and/or my guests to participate in the Sisu Nordic Sauna, I represent that:

I acknowledge that if I and/or my guests believe event conditions are unsafe, I and/or my guests will immediately discontinue participation in the activity of using Sisu Nordic Sauna.

*I CONSENT TO THE PARTICIPATION FOR MYSELF AND/OR MY GUESTS.

I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY for losses, costs, and damages I and/or my guests incur as a result of my and/or my guest’s participation in the Sisu Nordic Sauna.

*I UNDERSTAND THE NATURE OF THE ACTIVITY, and that the activity of using Sisu Nordic Sauna involves risks of serious bodily injury, including, but not limited to, permanent disability, paralysis and death, which may be caused by my own actions, or inactions, those of

other activity participants, the conditions in which the activity takes place, and that there may be other risks either not known to me or not readily foreseeable at this time. I acknowledge that if I and/or my guests believe event conditions are unsafe, I and/or my guests will immediately discontinue participation in the activity of using Sisu Nordic Sauna.

*I CONSENT TO THE PARTICIPATION FOR MYSELF AND/OR GUESTS

*I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY for losses, costs, and damages I and/or my guests incur as a result of my and/or my guest’s participation in the Sisu Nordic Sauna.

*I HEREBY RELEASE, DISCHARGE AND PROMISE NOT TO SUE Sisu Nordic Sauna, LLC, it’s respective administrators, directors, agents, officers and employers, and if applicable, owners and landlords of premises on which the Sisu Nordic Sauna is placed, from all liability, claims, demands, loses, or damages that I and/or my guests suffer which are caused or alleged to be caused in whole or in part by the negligence (but not reckless or intentional conduct) of Sisu Nordic Sauna, LLC or otherwise.

*I WILL INDEMNIFY, SAVE AND HOLD HARMLESS Sisu Nordic Sauna, LLC from any loss, liability, damage, or cost which any may incur, if, despite this release and waiver of liability, and assumption of risk, I or anyone on my and/ or my guest’s behalf makes a claim against any RELEASE.

*I HAVE CONSIDERED that if this waiver of liability was not as broad as it is, the cost for renting the Sisu Nordic Sauna would be considerably higher, and as I do not wish to pay a considerably higher cost, I waive the right to bargain for different waiver of liability terms.

*I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY AGREEMENT (collectively “Agreement”), UNDERSTAND THESE TERMS AND UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THIS AGREEMENT and have signed it freely and without any inducement or assurance of any nature. No person on behalf of Sisu Nordic Sauna, LLC has told me anything that is inconsistent with or contrary to the terms of this Agreement. I understand that, in reliance upon my signature on this form, voluntarily given, I may be permitted to participate in the Sisu Nordic Sauna. I intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. If any portion of this Agreement is to be held invalid, the balance shall continue in full force and effect.
